Whiskey brand Jack Daniel’s and toy maker VIP Products LLC are set to face off in the US Supreme Court over a dog toy that the former says infringes on its trademark. The chew toy features the phrase “Old No. 2 on your Tennessee Carpet”, a play on Jack Daniel’s “Old No. 7 Tennessee Sour Mash Whiskey”. Jack Daniel’s claims the toy confuses consumers and harms its brand. VIP Products argues that the toy is a parody and protected as free speech under the US Constitution’s First Amendment. The case centres on the Lanham Act, which prohibits using a trademark that causes customer confusion.
